The Illusion of Square Footage and the Allure of AI: Navigating Marketing Misrepresentation in Real Estate

On the surface, two potential areas for marketing misrepresentation in real estate—inaccurate square footage and misleading listing photographs—appear to have little in common. One is a numerical figure, the other a visual representation. However, both possess the potent ability to make a property seem more appealing than it truly is, and both carry significant risks of regulatory scrutiny for real estate agents. The rapid advancement and integration of technology into the property listing process now present a dual-edged sword: can it help agents avoid the pitfalls of misrepresentation, or is it more likely to become the very source of it?

The Persistent Challenge of Inaccurate Square Footage

The issue of inaccurate square footage in real estate listings is not a novel concern; it is a persistent, and increasingly scrutinized, problem. Historically, the reported square footage of a property has often been derived from local tax assessor records or carried forward from previous Multiple Listing Service (MLS) entries. This data is frequently accepted on faith, without independent verification by the listing agent. Tax records, in particular, are notoriously unreliable for this purpose. They may fail to account for significant additions, the finishing of basements, or substantial renovations that alter the usable living space. The ease with which an inaccurate number can propagate—from an outdated tax record to a previous MLS listing and subsequently to a new one—highlights a systemic issue where a lack of independent verification perpetuates errors.

Regulators are no longer viewing errors in square footage as mere oversights. The Real Estate Council of Ontario (RECO), for instance, has taken decisive action. In the spring of 2026, RECO issued four discipline decisions against agents who failed to independently verify lot size and square footage before advertising them. These decisions resulted in substantial fines, often running into the thousands of dollars, and mandated continuing education for the agents involved. This signals a clear shift in regulatory stance, emphasizing agent responsibility for due diligence. Furthermore, many MLS organizations have begun to tighten their own rules regarding the accuracy of property data, and a growing number of local taxing authorities are now explicitly cautioning against the use of their data for anything beyond assessment purposes, underscoring the unreliability of these sources for marketing.

Best practices for agents seeking to avoid unintentional misrepresentation in this area are twofold. First, a thorough understanding of local real estate board measurement standards, such as the ANSI Z765 standard for measuring finished square footage, is crucial. This standard provides a clear framework for what constitutes habitable and measurable space. Second, and perhaps most critically, agents must commit to measuring every listing themselves. This hands-on approach ensures accuracy and provides a defensible record of the property’s dimensions.

The Role of Technology in Ensuring Accurate Measurements

Fortunately, technology offers robust solutions to the challenge of ensuring precise property measurements. LiDAR (Light Detection and Ranging) based scanning technology has emerged as a powerful tool. Unlike traditional tape measures or laser rangefinders, LiDAR can capture a property’s interior with exceptional precision, especially in rooms with irregular shapes or angled walls.

LiDAR scanning, utilizing time-of-flight technology, can deliver high-accuracy property data. Some advanced technology tools can achieve measurement uncertainty as low as 0.5% or better for distance measurements on a floor plan, and 1% or better for overall square footage calculations. This level of precision is invaluable. It not only provides agents with a verifiable measurement record but also offers a strong defense should the property’s square footage be challenged by a buyer or regulatory body. This objective data moves beyond subjective interpretation and relies on quantifiable facts.

The Temptation of the Perfect, Digitally Enhanced Photo

The second, and rapidly evolving, area of marketing misrepresentation involves photographs edited or generated by Artificial Intelligence (AI). These digital manipulations can significantly alter a buyer’s initial impression of a property, often creating an illusion that diverges from reality. While practices like brightening dim rooms by digitally turning on lights or removing minor clutter have long been considered standard in real estate photography, the capabilities of modern editing tools have expanded dramatically. The temptation for agents and sellers to enhance listings by digitally swapping out flooring, altering paint colors, or even fabricating views through windows is now a growing concern.

Regulatory bodies are beginning to address this new frontier of digital misrepresentation, though they are, in some instances, playing catch-up. California was among the first states to enact legislation requiring real estate agents to disclose digitally altered photos and to provide buyers with access to the original, unaltered images. Wisconsin has since passed similar legislation, and other states are actively considering or debating such measures, indicating a growing awareness of the need for transparency in digital property representations.

In early 2027, the National Association of Exclusive Buyer Agents (NAEBA) issued guidance addressing virtual staging and digital photo alterations in real estate. The association clarified that while virtual staging and photo editing are not inherently improper, they cross a line when the "net impression" conveyed by the listing suggests the property is significantly different from its actual condition. NAEBA’s advice to buyers emphasizes the importance of requesting objective information, such as detailed floor plans and 3D virtual tours. These forms of digital media make it substantially more difficult for a buyer to be misled. Floor plans illustrate the dimensions and flow of a space, while 3D virtual tours present the property as it exists, rather than as a seller might wish it to appear.

The paradox of AI in real estate photography is that while technology is the enabler of misrepresentation through AI-retouched photos, it also offers potent solutions.

The Empowering Role of Technology in Visual Representation

Property capture technology, such as that used to generate immersive 3D virtual tours and detailed floor plans, provides the objective visual information that aligns with NAEBA’s recommendations. These outputs offer buyers a comprehensive understanding of a property’s layout, scale, and condition. They help a buyer envision the property as it truly is, rather than through a curated and potentially misleading lens. This type of data transforms a listing from a collection of attractive images into a complete and verifiable representation of the property. By grounding a buyer’s impression in factual, measurable data, rather than solely on curated visuals, technology fosters a more informed decision-making process.

The Foundation of Trust in Real Estate Transactions

Ultimately, the core issue in both inaccurate square footage and misleading photography is trust. Buyers need to be able to trust what they are seeing and reading before they can realistically envision themselves living in a property. Once that trust is eroded, it becomes exceptionally difficult to rebuild. Agents who prioritize transparency in their marketing efforts align themselves with a fundamental expectation that remains constant in the real estate industry: buyers desire an accurate and honest depiction of what they are purchasing.

Technology has the potential to both distort this picture and diminish trust, or conversely, to be leveraged as a powerful tool for establishing and reinforcing it. The encouraging news is that many of the technological solutions that agents are already employing, or can readily adopt, serve as the most effective defense against both the long-standing issue of inaccurate square footage and the emerging challenges of digitally manipulated imagery. By embracing technology that provides objective, verifiable information, agents can ensure that buyers understand precisely "what they see is what they get," thereby fostering a more transparent and trustworthy real estate market.
